These Terms explain the rules for using PERDIFY, the AI-driven interrogation mystery game and related services operated by Banana Pancakes s.r.o.

1. Who We Are

PERDIFY is developed and published by Banana Pancakes s.r.o., a company registered in the Czech Republic.

2. Your Agreement

By downloading, accessing, or using PERDIFY, you agree to these Terms and our Privacy Policy. If you do not agree, do not use PERDIFY.

These Terms apply to the PERDIFY iOS app, website, support channels, and related online services. Additional terms may apply to some features, such as Apple App Store terms or purchase terms shown inside the app.

3. App Store License

PERDIFY is licensed to you, not sold. If you download PERDIFY through the Apple App Store, your use of the app is also subject to Apple's applicable App Store and Licensed Application End User License Agreement terms.

These Terms are intended to supplement those Apple terms. If a conflict exists between these Terms and mandatory Apple terms for App Store distribution, the Apple terms control for that specific conflict.

4. Eligibility

PERDIFY is intended for mature players aged 17 or older. You may not use PERDIFY if you are under 17. If local law requires a higher age to agree to online terms, you may use PERDIFY only if you meet that age or have permission from a parent or legal guardian.

5. Accounts and Security

Some features require an account. You are responsible for the information you provide, for keeping your login credentials secure, and for activity under your account.

  • Provide accurate account information and keep it reasonably up to date.
  • Do not share, sell, or transfer your account without our permission.
  • Tell us promptly if you believe your account or credentials have been compromised.
  • You may delete your account through the app where that feature is available.

6. Gameplay, AI, and Voice Features

PERDIFY uses AI systems to generate suspect dialogue, character responses, game summaries, voice output, and related mystery gameplay. AI responses may be fictional, incomplete, inconsistent, or unexpected. They are part of the game experience and should not be treated as factual, professional, or safety-critical advice.

If you use voice interrogation, the app may process microphone audio, transcripts, prompts, and generated replies so the service can understand your questions and respond in character. You must not submit voice or text content that you do not have the right to provide.

7. Your Content

You may submit prompts, questions, feedback, support messages, voice input, text messages, and other content to PERDIFY. You keep any rights you have in your content.

You grant Banana Pancakes s.r.o. a worldwide, non-exclusive, royalty-free license to host, process, transmit, display, reproduce, and use your content as needed to provide, maintain, secure, debug, support, and improve PERDIFY. This license ends when your content is deleted from active systems, except where retention is reasonably needed for legal, security, accounting, backup, dispute, refund, fraud-prevention, or App Store compliance purposes.

8. Purchases, Subscriptions, and Credits

PERDIFY may offer paid features, subscriptions, consumable credits, or other digital entitlements through Apple StoreKit. Prices, billing periods, renewal terms, and included benefits are shown in the app or App Store before purchase.

  • Payments are processed by Apple. We do not receive your full payment card details.
  • Apple's App Store terms and refund policies apply to App Store purchases.
  • Credits, subscriptions, and digital entitlements are personal, non-transferable, and may be used only inside PERDIFY.
  • Consumable credits may be used, reduced, expired, revoked, or adjusted according to the rules shown in the app and these Terms.
  • If Apple refunds, cancels, reverses, or revokes a transaction, related credits or entitlements may be removed or adjusted.
  • We may grant promotional, feedback, or bonus credits. Promotional credits have no cash value and may be changed or withdrawn where permitted by law.

9. Support

If you need help with gameplay, account access, purchases, technical issues, safety concerns, or privacy requests, contact us at support@perdify.com or use the Support page.

10. Acceptable Use

You must not misuse PERDIFY or use it in a way that harms other users, us, or the service.

  • Do not break the law, violate another person's rights, or submit illegal content.
  • Do not harass, threaten, abuse, exploit, or impersonate another person.
  • Do not use PERDIFY to generate, request, or roleplay sexual content, sexually explicit scenarios, sexual content involving minors, coercive sexual themes, or other content that abuses the AI character system or conflicts with the app's intended mystery gameplay.
  • Do not submit content involving sexual exploitation, child abuse, non-consensual intimate material, or instructions for serious harm.
  • Do not probe, scan, attack, overload, disrupt, or attempt to bypass the security or safety systems of PERDIFY.
  • Do not reverse engineer, scrape, crawl, copy, or extract the app, game content, models, prompts, systems, or data except where law expressly permits it.
  • Do not use automation, bots, scripts, or unauthorized tools to create accounts, farm credits, manipulate gameplay, or burden the service.
  • Do not resell, sublicense, rent, lease, or commercially exploit PERDIFY without our written permission.

11. Our Content and Intellectual Property

PERDIFY, including its name, logos, artwork, characters, scenarios, dialogue systems, software, design, text, audio, game mechanics, and other materials, is owned by Banana Pancakes s.r.o. or its licensors and is protected by intellectual property laws.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use PERDIFY for personal entertainment. We reserve all rights not expressly granted.

12. Third-Party Services

PERDIFY depends on third-party services for app distribution, authentication, hosting, infrastructure, AI processing, speech-to-text, text-to-speech, email, support, diagnostics, and payment-related services. These services may change, become unavailable, or operate under their own terms and policies.

13. Availability and Changes to PERDIFY

We may update, balance, add, remove, suspend, or discontinue features, cases, scenarios, characters, modes, AI providers, prices, subscriptions, credits, or other parts of PERDIFY. We may also limit use to protect security, reliability, legal compliance, or service costs.

We try to keep PERDIFY available, but we do not guarantee uninterrupted or error-free operation. Maintenance, outages, provider failures, security incidents, or technical problems may affect the service.

14. Suspension and Termination

We may suspend or terminate access to PERDIFY, remove content, or adjust credits or entitlements if we reasonably believe you violated these Terms, created security or fraud risk, misused purchases or credits, violated the law, or created risk for PERDIFY, other users, Apple, service providers, or Banana Pancakes s.r.o.

You may stop using PERDIFY at any time. Sections that by their nature should survive termination, including intellectual property, payment, acceptable use, disclaimers, liability, dispute, and contact provisions, will survive.

15. Disclaimers

PERDIFY is provided for entertainment on an "as is" and "as available" basis to the maximum extent permitted by law. We do not guarantee that PERDIFY will be uninterrupted, secure, error-free, compatible with every device, or that AI-generated content will be accurate, complete, or suitable for every player.

Nothing in these Terms excludes warranties, rights, or remedies that cannot be excluded under applicable consumer protection law.

16. Limitation of Liability

To the maximum extent permitted by law, Banana Pancakes s.r.o. will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, business, or service availability arising from or related to PERDIFY or these Terms.

Nothing in these Terms limits liability where it would be unlawful to do so, including liability for intentional misconduct, gross negligence where it cannot be limited, or non-waivable consumer rights.

17. Governing Law and Consumer Rights

These Terms are governed by the laws of the Czech Republic, except where applicable consumer protection law gives you mandatory rights under the law of another country or region. If you are a consumer in the European Union, you may have mandatory rights in your country of residence that these Terms do not override.

Before starting a formal dispute, please contact us at support@perdify.com so we can try to resolve the issue.

18. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date above. If changes materially affect your rights or use of PERDIFY, we will provide additional notice where required by law. Continued use after updated Terms take effect means you accept the updated Terms.
